Please note that EthiopiaBIM is currently in Beta Version 2.0, and certain features or services may still be under development. As a result, you may experience issues or limitations during this testing phase.

1. Acceptance of Terms

By using EthiopiaBIM’s Beta Version 2.0 website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the website.

2. Notice to “USERS”

• The Objects are only to inform AEC professionals of the availability of the product in Ethiopia. And are as supplied by a contributor not for professional advice, decision of use lies purely on the professional and/or owner, using the objects on the design phase of the project. Users are encouraged to give feedback on BIM objects using contact us prompt.
• EthiopiaBIM is not liable for any comment made by employees, users, website, contributors, on the products found on the website here thereof, known as “object” nor guarantees the quality, quantity, structure and processing or manufacturing of products.
• EthiopiaBIM is not responsible for the direct, indirect, punitive, consequential damages or latent or apparent defects of the product. You should contact the product supplier and/or manufacturer in this case. Furthermore, the contact Regional and/or Ethiopian licensing, Standard authority when such problems arise.
• There are no special relationship b/n the website owner and/or user/ contributor and legal promoters, other than information brokerage.
• EthiopiaBIM as an information disseminator is not part of the offer & acceptance or contractual relationship in any manner/form to be made b/n the product advertiser and the visitor/ user of the advert made by any brand and/or product on the website.
• EthiopiaBIM is not responsible for the difference of information provided on the website and actually sold by the product supplier, before the information posted on its website & after its duration on it, quality assurance is made by the certifying bodies such as industry standards certifiers, regional standards, and Ethiopian standards.
• EthiopiaBIM is not responsible for the delivery of the product promoted on the website or the costs & expenses the visitors/users, in their transaction with the product supplier.
• EthiopiaBIM is not responsible for any physical property rights and obligations or trade abuses or loss of income or profits, price inflations or deflation or contractual damage/ extra-contractual damages arising out of the objects in the website.
• EthiopiaBIM is not responsible for the quality of the product in terms of customer's expectation and satisfaction which is exclusively confined to the subjective appreciation of the user/contributors of the website, Contact the product suppliers, regional and/or federal Ethiopian standards authority for complaint in hierarchy and/or all at once.
• EthiopiaBIM is not liable for the introduction stage, growth stage, maturity stage & the declined stage in terms of the price, promotion and distribution. Furthermore, it is not responsible for the demand & supply status of the product in connection with its life cycle.
• The website is not liable to any physical, chemical or biological events occurring upon manufacturing, installation and application of products from its internal structure and/or external additives of the product.
• EthiopiaBIM doesn’t participate in market manipulation or doesn’t collude with one brand and/or product or any other entity to disrupt healthy competition.

3. Copyright and Intellectual Property

All content on the EthiopiaBIM website, including but not limited to text, graphics, logos, images, videos, designs, software, and downloadable BIM files, is the intellectual property of EthiopiaBIM or its contributors or acquired through legal channel and is protected by copyright, trademark, and other intellectual property laws.

Ownership: All rights, title, and interest in the website content remain the exclusive property of EthiopiaBIM or its licensors unless otherwise stated.

License to Use: You are granted a limited, non-exclusive, and revocable license to access and use the materials on this website solely for personal or professional use related to the services offered by EthiopiaBIM.

Restrictions: You may not copy, reproduce, distribute, transmit, display, perform, modify, create derivative works from, or exploit any content from EthiopiaBIM without prior written consent, except for your own professional use of BIM, texture, artwork, data, and files as intended by the website.

4. Contributors and object

As a user of EthiopiaBIM Beta Version 2.0, you may contribute objects such as BIM files, texture artwork, data…etc. here and then after known as Contributors. By submitting content, you agree to the following:

Your Ownership: You retain ownership of any intellectual property rights of objects you developed or are a legal representative of the object developers or legal representative of object rights owners, hereby entrusted with its lawfully dissemination via platform such as Ethiopiabim as contributor.

License to EthiopiaBIM: By submitting as Contributor, you grant EthiopiaBIM a worldwide, non-exclusive, royalty-free, perpetual license to use, modify, display, reproduce, and distribute your contributions in connection with the operation of the website.

Responsibility: You are solely responsible for ensuring that your contributions do not infringe any third-party rights, including copyright, trademark, or privacy rights.

Object quality: object qualities are to be determined via software and industry standards such as ISO, BIM, PIM…etc, yet Ethiopiabim retains the right to reject contributors objects including but not limited to ISO, BIM, PIM…etc. level standard models.

Object quantity: as beta version 2.0 website, Ethiopiabim has to limit the number of contribution to a maximum of 100 per contributor, due to varying reasons.

Time limitations: unless unforeseen conditions arise to approve or reject process one object, will be done in maximum 15 days. Furthermore, Ethiopiabim beta version 2.0 website reserve the right to close free uploads such as the one currently open for contributors at any time without notice to its users, contributors or other entities and retain the data as submitted by the contributor.

5. Beta Version Disclaimer: Limitations and Issues

As a beta version 2.0, EthiopiaBIM is still undergoing testing and development. While, we aim to fully protect your privacy, the following challenges may arise:

Technical Glitches: Issues like data processing errors or system downtimes could occur, leading to temporary lapses in privacy protection.

Limited Staff Support: Due to the limited resources in this phase, response times for addressing privacy concerns or user data issues may be slower than anticipated.

System Weaknesses: Since the system is being designed to cater for a specific environment, the system might be vulnerable which could lead to unintentional vulnerabilities.

We are working diligently to address these challenges (if any) and improve our systems to ensure your privacy is fully protected in the final version.

6. Copyright Infringement Policy

EthiopiaBIM respects the intellectual property rights of others. If you believe that your object has been copied or used in a way that constitutes copyright infringement, please notify us with the following information:

• A description of the copyrighted work you claim has been infringed.
• A description of where the infringing material is located on the website.
• Your contact information (name, email address, phone number).
• A statement affirming your good faith belief that the use of the material is unauthorized.
• A statement under penalty of perjury that the information you provided is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
• Please refer privacy policy to understand how we use your personal information.
• EthiopiaBIM reserves the right to remove or disable access to any account or object that are alleged to infringe intellectual property rights.

7. Prohibited Activities

You agree not to engage in any of the following activities:

• Using the website for unlawful purposes or to solicit others to perform illegal acts.
• Attempting to gain unauthorized access to any part of the website or its systems.
• Uploading or transmitting viruses or malicious code that could disrupt the functionality of the website.
• Misusing EthiopiaBIM’s intellectual property or that of its contributors.

8. Termination of Use

EthiopiaBIM reserves the right to terminate your access to the website without notice, if you violate these Terms or if deemed necessary during the beta phase.

9. Disclaimer of Warranties

EthiopiaBIM provides its website and content on an "as is" and "as available" basis. Due to the beta status, we do not warrant that the site will be uninterrupted, error-free, or fully secure. We disclaim all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

EthiopiaBIM and its contributors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Beta Version 2.0 website or its content.

11. Changes to the Terms

EthiopiaBIM reserves the right to modify these Terms and Conditions at any time during the beta phase. Any changes will be posted on this page, and your continued use of the site constitutes acceptance of those changes.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Ethiopian digital law, Ethiopiabim abides not only to Ethiopian law but also international laws such BIM related regulations, standards…etc. . You agree to submit to the exclusive jurisdiction of the courts located within Ethiopia even for the international laws not-adapted to Ethiopian context.
